Terms of Service

OwnTheBookings provides direct-booking website services for short-term-rental owners, including but not limited to:

• Website builds: turnkey, templated direct-booking websites, typically one to three pages, with year one of hosting and care included. Some packages include a Lodgify booking widget.
• Care Plan: ongoing hosting and care for your website after year one.
• Growth Plan: ongoing hosting and care plus additional growth services.

Service descriptions, features, and pricing are detailed at ownthebookings.com/#pricing and are subject to change with reasonable notice. Use of any third-party platform, such as Lodgify, is subject to that provider’s own terms and fees.

You are solely responsible for:

• The photos, text, logos, and other content you provide for your website, including having all rights needed to use them.
• Your guests, bookings, guest communications, payments, refunds, and disputes.
• Your own insurance coverage, rental agreements, and house rules.
• Collecting and paying any taxes that apply to your rentals.
• Complying with all laws, HOA rules, permits, and short-term-rental regulations that apply to your property.

Website builds are paid at the time of purchase. All prices are listed in US dollars.

After year one, continued hosting and care require a Care Plan or Growth Plan, offered on a monthly or annual subscription basis. Monthly subscriptions are billed on the same date each month. Annual subscriptions are billed in full at the start of each annual term. Prices are subject to change with 30 days advance notice to active subscribers.

We use Stripe as our payment processor. We do not store your full card number. By purchasing a subscription you authorize us to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time by contacting us at host@ownthebookings.com or by calling (833) 440-0999.

Monthly subscribers who cancel will retain access to their services through the end of the current billing period. No partial refunds are issued for unused days in a monthly billing period.

Annual subscribers who cancel within 30 days of purchase are eligible for a prorated refund for unused months. Cancellations after 30 days of an annual subscription are not eligible for a refund.

Website builds are fully refundable if cancelled before work begins. Once your website has been delivered, the build fee is not refundable.

Cancellation of a subscription does not automatically delete your account or data. Contact us if you wish to request data deletion.

Website builds are typically delivered within about 7 business days after we receive your photos and content.

We reserve the right to pause or terminate service delivery, including taking a hosted website offline, in the event of non-payment, violation of these Terms, or other circumstances within our reasonable discretion.

You agree not to use our services or website to:

• Violate any applicable law or regulation, including short-term-rental rules.
• Transmit spam, unsolicited messages, or deceptive content.
• Infringe on the intellectual property rights of others.
• Interfere with the operation of our website or services.
• Provide false, misleading, or fraudulent information, including false listings.
• Resell or sublicense our services without our written consent.

We reserve the right to suspend or terminate your access to our services if you violate these Terms.

All content on ownthebookings.com including text, graphics, logos, images, and software is the property of LeadsAlive.ai LLC and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission.

You keep ownership of the photos and content you provide, and you grant us a limited license to use them to build, host, and maintain your website.

You own your content and your domain. Our website templates and code remain the property of LeadsAlive.ai LLC and are licensed to you for use while we host your website. If you leave, you may export your content.

By submitting a form on our website or purchasing our services, you agree to receive emails from OwnTheBookings about your inquiry, purchase, and website, plus tips and offers. You can unsubscribe from marketing emails at any time.

We currently communicate by email only. If we add text messaging, we will send texts only to people who opt in separately, including reminders, tips, and offers. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any message. For help, reply HELP or contact host@ownthebookings.com.

Our services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. We do not guarantee any particular number of bookings, amount of revenue, or search ranking. Individual results will vary based on your property, market, and how you use your website.

To the maximum extent permitted by applicable law, LeadsAlive.ai LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost bookings or profits, arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid us in the 90 days preceding the claim.

These Terms are governed by the laws of the State of Texas without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved through binding arbitration in Collin County, Texas, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations or other urgent matters.
